Non-Muslim to Muslim and Marriage
Question:
Salam, Sir
I wanted to ask you that when a married muslim guy becomes a non muslim either due to blasphemy or any other act or even by his choice and does not tell any one but after some days or time he repent and reform, every thing seems fine till this but what about nikkah, the woman he is married to, will the nikkah be still valid or void?
Thank you
Answer:
Salam,
First, one can be considered as non-Muslim only if he himself announces this to the others or if the state (as the representative of the whole community) call him or people who hold the same beliefs as him, non-Muslim.
Second, marriage is a contract. The condition to marry a Muslim or one who believes in one God (Ahl Al-Kitab) may be considered as the prerequisite for marriage of a Muslim but is not the condition for the continuous validity of marriage. Therefore the nikah is still valid in the case that you mentioned. There is only one situation that can make the nikah invalid. That is if the couple added a condition to their marriage contract that if in future one of them or either of them becomes non-Muslim then the marriage contract is void.
